Notes for Maud Fraunceys
m.(1) John Aubrey, (2) Sir Alan Buxhall KG and (3) John Montacute.a brother
She was not an heir as she had a brother, also Adam, who (see CP re Salisbury) was MP and Sheriff of London. While the preceeding sentence is true, it ignore the rules of the game; heirs to land and titles in medieval times had to be legitimate. And children born out of wedlock (as we know well from my brother Martin’s studies of Richard Lybbe The Slave) may only be provided for in the lifetime of their father, not by their will. Maud’s brother Adam was born before his parents married (probably because Adam the father’s unknown first wife, and mother of some children who all d.inf., was still alive).
In fact in the IPM for Adam the father, it was declared that “Maud wife of John Aubrey is his daughter and heir” and I now see why this was correct. So, Dec 2010, I am reverting this Maud to being a heraldic heir, thus allowing us to quarter the Fraunceys arms.
