In November 1886 Higginson adopted, by deed poll, the name Henry Peter Higginson-Whyte-Melvillevi.
The marriage was declared a nullity in Sep 1887, by the Court of Divorce and Matrimonial Causesvii upon the grounds that at the time of the marriage Higginson was still legally married to his first wife notwithstanding a divorce had been granted by the Circuit Court of the County of Wayne, Michigan, USA on 6 Mar 1886: the English Court holding that by the law of the United Kingdom a marriage contracted between English subjects could not be dissolved by the Court of any other country, unless the parties to the marriage had abandoned their domicile in the United Kingdom, and that on the evidence it was clear that neither Higginson nor his first wife had acquired American domicile.
